2.) You agree to abide by the laws of the country, state and city in which you live in.

3.) You agree that you are responsible for reporting any earnings and are acting as an independent retailer through this site. You are also responsible for paying any taxes in relation to the selling of your products as the buyers are buying directly from you. As CyberLake Mall does not calculate taxes at the end of purchase. You must include taxes if applicable in your prices. You should also note this in your product description.

3a.) CyberLake Network Services cannot and will not be responsible for tracking applicable income taxes earned or for sales taxes due to local tax boards. You should check with local tax boards to ensure compliance with all tax rules.

3b.) You agree to hold CyberLake Network Services harmless for any charges related to taxes due by you, or that you as a vendor should or should have collected.

4.) You agree to service and consult with all Buyers of your products in the event of any disputes that may arise from the use of this service.

5.) You agree that CyberLake Network Services and CyberLake Network Services - CyberLake Mall will hold no liability, expressed or implied, in relation to the products you sell through this service.

5.) In the event of a dispute between you and the Buyer which is unresolved, you agree to settle the agreement in such a fashion as to not tarnish the name of CyberLake Network Services or CyberLake Mall.

6.) If you need assistance resolving disputes with a Buyer, please contact malladmin@cyberlake.com. In the event a refund is necessary, you are responsible and will be held liable for any expenses incurred on your behalf by CyberLake Network Services - CyberLake Mall.

7.) If a Buyer files a complaint with CyberLake Network Services or CyberLake Network Services - CyberLake Mall, a copy of the complaint will be forwarded to you for review. If the complaint is found to be legitimate CyberLake Network Services or CyberLake Network Services reserves the right to terminate this contract without refund or warning. (Depending on severity of complaint.) Vendor will also be held liable for any expenses inccured in settling the complaint.

8.) Vendor agrees to provide all services and products to the Buyer upon demand, after payment in full has been received from the Buyer.

9.) Vendor will not imply expressly or implicitly that their products are sponsored, supported, recommended or warrantied by CyberLake Network Services or CyberLake Network Services - CyberLake Mall.

10.) Vendor further agrees that obscene items or inappropriate items are expressly forbidden from appearing on this site. This is strickly enforced. If items are posted in violation of this agreement. Your service will be terminated, and Vendor is liable for all expenses related to the removal of their products and services from CyberLake Network Services - CyberLake Mall site. All balances and fees will be due immediately upon termination.

11.) The service fee to use CyberLake Mall, is a one time $50 setup fee, as well as 15% of all final sales. There is a minimum monthly service fee of $2.00. These fees are payment for the use of CyberLake Network Services - CyberLake Mall site and administration of site.*

*All final sales for the purpose of CyberLake Network Services and CyberLake Mall will be the total of all sales.

12.) It is the responsiblity of the Vendor to inform CyberLake Network Services/CyberLake Mall of any refunds on final sales or non-payments. Non-payments and refunds must be verified by e-mail to CyberLake Network Services. In the event CyberLake Network Services discovers the Vendor has submitted a false claim for non-payment or refund, Vendors access to this site and all services will be terminated and Vendor will be subject to all reinstatement fees and charges incurred to recover fees owed to CyberLake Network Services.

13.) In the event a refund is necessary by CyberLake Network Services, it will be in the form of a credit on your account and will show up on your next statement. Unless you are terminating your service then CyberLake Network Services will issue a check in the amount due which will be mailed out in 4 to 6 weeks of the termination notice.

14.) Vendor agrees to pay all accounts in full upon receipt of a bill. Bills will be sent via e-mail after the 25th of each month and will be due by the 15th of the following month. If your account balance is not current on the 15th of the month, CyberLake Network Services and/or CyberLake Network Services - CyberLake Mall reserves the right to terminate your account immediately and suspend all services in CyberLake Mall. Once your account is past due you will be charged $5 per month for reminder notices and be held liable for all charges incurred by CyberLake Network Services in attempting to collect. Any Vendor with a past-due account for more than thirty days will be subject to immediate termination of all services provided through CyberLake Network Services - CyberLake Mall. In addition Vendor is responsible for all costs, charges and fees incurred by CyberLake Network Services to collect for any past-due accounts.

15.) Billing will be once a month, as described above, unless the total owing on your account exceeds $200.00. And then it is at the discretion of CyberLake Mall administration.

16.) If there is a dispute in regards to your bill. Vendor agrees to contact malladmin@cyberlake.com with a detailed explaination of the disagreement. Further Vendor agress CyberLake Network Services and/or CyberLake Network Services - CyberLake Mall will have the final say in all disputes.

17.) To be removed from CyberLake Network Services - CyberLake Mall and discontinue service fees you must request in writing that we remove you from CyberLake Mall. (See address above.) You must include in the letter your username and password. As well as other identifing information you submitted when you signed up with CyberLake Network Services - CyberLake Mall. This is for security purposes to ensure you are not cancelled by someone else.

18.) By using this site you are consenting to the terms and conditions set forth above. Vendors are also bound by the terms and conditions set forth in their contracts with CyberLake Network Services - CyberLake Mall. You also agree to the terms and conditions set form under "Terms and Conditions" located on the main page.
